Free Trip to Prince Edward Island Contest

Official Contest Rules and Regulations

 

The Prince Edward Island Preserve Company’s (“PEI Preserve Co.”) Free Trip to Prince Edward Island Contest (the “Contest”) is administered by 6773443 Canada Inc. (the “Sponsor”). By participating in this Contest, each contestant agrees to be legally bound by these Official Contest Rules (the “Official Rules”). 

 

Void where prohibited by law.

 

1.0 Contest Period:

 

1.1 The Contest is run by the Sponsor and shall take place from 12:00:01 a.m. Atlantic Time (“AT”) on December 20, 2020 to 11:59:59 p.m. AT on December 19, 2021 (the “Contest Period”). The Contest shall run annually, in the sole discretion of the Sponsor, thereafter from December 20th  to December 19th of the each year. The Sponsor reserves the right to cancel, terminate, modify, amend, extend or suspend the Contest, without prior notice, if any factor interferes with its proper conduct as contemplated by the Official Rules.

 

2.0 Eligibility: 

 

2.1 To be eligible to participate in the Contest by submitting an Entry (as defined below), you must:

(i) be a legal resident of Canada (excluding Quebec), one of the 50 United States of America, or the District of Columbia; and

(ii) have reached the age of 19 at the time you submit your Entry.

 

2.2 You are not eligible to participate in the Contest if you are: (a) an employee, representative or agent of Sponsor, or an employee or agent of a Sponsor (“Employee”), (b) an immediate family member (defined as mother, father, brother, sister, her, daughter, or spouse, regardless of where you reside) of an employee ("Family Member") or (c) a person domiciled with an Employee or a Family Member.

 

2.3 At any time, Sponsor will have the right to request from any individual who has participated in the Contest (each an "Entrant ") for proof of identity. Failure to provide proof within a reasonable time or the provision of false or misleading information could result in the Entrant's disqualification. Contest is subject to all applicable federal, state, provincial, territorial and local Laws and Regulations. Sponsor reserves the right to disqualify any Entrant who, in Sponsor's sole discretion, do not comply with Official Rules or has tampered with the Entry process (where applicable by law). Void outside of Canada, the 50 U.S. states, DC, and where prohibited by law.

 

3.0 How to Enter:

  • enter your full name, location, and valid email address;
  • agree to become a subscriber to PEI Preserve Co.’s Monthly Online Newsletter;
  • agree to accept marketing materials from PEI Preserve Co.; and
  • agree to the terms and condition of these Official Rules. 

Click the “Submit” button to complete your entry (the “Standard Entry”). To be eligible, your Standard Entry must be received within the Contest Period. All eligible Standard Entries received during the Contest Period will be entered into the random prize draw.

3.3 In-store: Same Rules apply. 

3.4 Additional Entry: Once you have completed your Standard Entry (as defined above), you can earn an additional entry in the random draw by referring a friend to the Website. 

 

  • Online: Upon completing your Standard Entry online described in paragraph 3.2, follow the onscreen instructions to tell your friends about the Contest to receive additional entries into the random draw (“Refer-A-Friend Entry”). Entrants will receive one (1) Refer-A-Friend Entry for each friend that becomes a member of the PEI Preserve Co. loyalty program, during the Contest Period. 

 

  • In-store: Upon completing your Standard Entry described in paragraph 3.3, tell your friends about the Contest, by providing friends email addresses in the space shown on the paper Membership form, to receive additional entries into the random draw (“Refer-A-Friend Entry”). Entrants will receive one (1) Refer-A-Friend Entry for referring a friend to the Website, during the Contest Period. Limit of one (1) Refer-A-Friend Entry for each friend that becomes a member of the PEI Preserve Co. loyalty program, during the Contest Period.

 

3.5 Limit: Limit of one (1) Standard Entry or one (1) Paper Entry per person/email address permitted during the Contest Period. 

 

3.6 Existing Members: In any subsequent Contest Periods, existing PEI Preserve Co. Members (defined as Members at the date the new Contest Period begins) will be given one (l) Member Entry and will be automatically entered into the random prize draw for each new Contest Period.

 

3.7 Disqualification: Any attempt or suspected attempt to exceed the number of permitted Entries for the Contests during the Contest Period, or any use of robotic, automatic, or programmed entry methods, or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your Entries to the Contest. Entries that are late, lost, stolen, illegible, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, or that contain false information or do not conform with or satisfy any or all of the conditions contained in these rules will be deemed to be void.

 

3.8 Entry: the Standard Entry, Refer-A-Friend Entry and Member Entry may be collectively or individually referred to as an “Entry” or “Entries” in this document and any material related to the Contest. 

 

4.0 Contest Prize:

 

4.1 One Annual Prize: One (1) trip for two to Prince Edward Island (the “Prize”).  Approximate retail value of trip is estimated to be $4,500.00 CDN before any applicable taxes (based on Canadian or Continental United States departure).

 

The Trip for Two includes:

  • Two (2) return economy airfare to Charlottetown, Prince Edward Island from the nearest major airport to the home of the Contest winner;
  • Seven (7) nights of standard hotel accommodation (double occupancy);
  • One (1) standard rental car for Seven (7) days;
  • Meal vouchers to be provided by the Sponsor; and
  • Entertainment vouchers to be provided by the Sponsor.

 

4.2 The winner of the Trip for Two and his or her respective guest shall be responsible for any costs not specifically described above in paragraph 4.1. All travel arrangements, accommodations and events will be arranged by the Contest Sponsor, in its sole discretion. Actual value of the Trip for Two will depend on the location of the winner’s residence.

 

4.3 The retail values set above are based on approximate prize values in Canada at the time of printing of these Official Rules.  All estimated retail values do not include applicable goods and services tax, provincial or sales and use taxes.  Winners are not required to pay such taxes upon receipt of the prize.  All other taxes on prizes other than taxes specifically referred to in these Official Rules are the responsibility of the winners. 

 

4.4 Prizes must be accepted as awarded and are not convertible to cash.  The Prize is not transferable or convertible to cash, except as specifically provided herein. The Prize may not be exactly as shown in promotional materials.  In case of unavailability of any prize, to accommodate for a disability, or for any other reason and in Contest Sponsor’s sole discretion, Contest Sponsor reserves the right to substitute a prize for a prize equal or greater value.

 

4.5 If the winner of the Trip for Two is a resident of the Province of Prince Edward Island, the winner may, in the Sponsor’s complete discretion, assign the prize to a person(s) of their choosing as long as the chosen person(s) is compliance with the Official Rules. 

 

4.6 Time to Use: The Prize must be used within two years of the notification of winning. The Sponsor may extend the time allowed to use the Prize in its absolute discretion.

 

5.0 Contest Draw Process

 

5.1 Random Draw: On or about December 21st, 2019 at 5:00 p.m. (the “Draw Date”) at the offices of the Sponsor in Hunter River, Prince Edward Island, one (1) entry will be randomly selected from a server generated list of all Entries received by the Sponsor’s servers during the Contest Period. The Entrant who owns the selected Entry, and who is otherwise eligible to win, will be the selected contestant who is eligible to win the Prize subject to compliance with these Official Rules.

 

5.2 Odds of Winning: The odds of winning the Grand Prize are dependent on the number of eligible entries received by the Sponsor during the Contest Period in accordance with these Official Rules.

 

5.3 Contacting Selected Entrant: Sponsor, or its designated representative, will make a minimum of three (3) attempts to contact the selected Entrant by telephone or email using the information provided at the time of entry within ten (10) business days of the Draw Date. If the selected Entrant cannot be contacted (i.e. does not reply to the email from the Sponsor or its representative) within ten (10) business days of the Draw Date or there is a return of any notification as undeliverable, then he/she may be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate selected entrant from among the remaining eligible entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).

 

5.4 Confirming Winner: In order to be declared the confirmed Prize winner the selected entrant must:  

  • meet the Contest eligibility criteria; 
  • compliance with these Official Rules; 
  • correctly answer, a time limited mathematical skill testing question, without assistance of any kind, whether electronic or otherwise, to be administered by phone at a mutually convenient time (not applicable to residents of Quebec, the United States of America and the District of Columbia); and
  • sign and return a Declaration and Release Form prepared by the Sponsor within five (5) business days of notification by e-mail. The Declaration and Release Form shall include the following:
    • confirms compliance with these Official Rules;
    • acknowledges acceptance of the Prize, as awarded; 
    • releases the Sponsors, its designated representatives and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and 
    • agrees to the publication, reproduction and/or other use of the selected entrant’s name, photograph, image, likeness, biographical information, any statements made regarding a prize, place of residence, and/or voice for advertising and promotional purposes in perpetuity and in any manner and in any medium (including the Internet), without any compensation or further attribution or notification.

 

If the selected Entrant:

  • fails to correctly answer the mathematical skill testing question in the manner prescribed;
  • fails to return the properly executed Declaration and Release within the specified time;
  • cannot accept the prize for any reason; or
  • otherwise fails to comply with the Official Rules;

then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select by random draw from among all remaining eligible entries an alternate selected contestant as the potential winner of the Prize or other prize (in which case the foregoing provisions of this section shall apply to such new potential prize winner). Notwithstanding any other provision of these Official Rules, the Sponsor reserves the right to determine how the presentation of a prize will occur and this may be either in a media event, by mail or in person.

 

6.0 General 

 

6.1 By participating in this Contest, Entrants agree to be bound by these Official Rules and all decisions of the Contest Sponsor, which are final.  Without limitation, Contest Sponsor reserves the right to administer a skill-testing question to Canadian residents (excluding Quebec, the 50 states of United States of America, and District of Columbia) as it deems appropriate to address discrimination or disability issues. 

 

6.2 By accepting a prize, the prize winner releases the Contest Sponsor, and their affiliated and related entities, the prize suppliers, and their respective officers, directors, employees and agents, including, without limitation, their advertising and promotional agencies and the independent contest organizations (“Releasees”), from any and all liability, loss or damage incurred in connection with this contest and, without limiting the generality of the foregoing, with respect to the awarding, receipt, possession and/or use or misuse of any prize and acknowledge that the Releasees have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied in fact or in law, including but not limited to its quality, mechanical condition or fitness for a particular purpose. 

 

6.3 All Entries become the property of the Sponsor. The Releasees assume no responsibility for lost, delayed, incomplete, incompatible or misdirected Entries. All Entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means or do not conform to or satisfy the conditions set forth in these Official Rules, may be disqualified by the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. 

 

6.4 The Releasees will not be liable for any failure of the Website during the Contest; for any technical malfunction or other problems relating to telephone networks or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Contest Parties for any reason including, but not limited to, technical problems or traffic congestion on the internet or at any website; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest. 

 

6.5 All Entries are subject to verification. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). 

 

6.6 The Sponsor reserves the right to withdraw or amend this Contest (or to amend these Official Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules. 

 

6.7 Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Official Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind. 

 

6.8 In the event there is a discrepancy or inconsistency between the English language version and any other language version of these rules or any contest materials, the English version shall prevail, govern and control.  In the event there is a discrepancy or inconsistency between disclosure or other statements contained in any contest materials and the terms and conditions of these rules, these rules shall prevail, govern and control.

7.0 Privacy

 

7.1 Each winner will be notified by and will receive their prize from the Sponsor or its designated representatives.  All prize claims become the property of the Contest Sponsor and no correspondence will be entered into except with potential winners.  By participating in this contest, contest winners are deemed to have consented to the disclosure of their personal information to prize suppliers for limited purpose of delivering of prizes.  By entering this contest, each entrant expressly consents to Contest Sponsor, its agents and/or representative, storing, sharing and using the personal information only for the purpose of administering the contest. No further informational or marketing communications will be received by entrants unless entrants provide the Sponsor with explicit permission to do so as indicated on the Scratch and Win ticket.

 

7.2 By claiming the Prize, prize claimants consent to the use of their name and/or photograph, and/or place of residence, without compensation, in any publicity carried out by the Contest Sponsor. Where applicable, Contest Sponsor reserves the right to publicly award prizes at the Sponsor’s location.

 

7.3 Anyone accompanying the winner in connection with the prize shall sign a release agreeing that their name, image and/or voice may be used for advertising purposes related to this Contest free of charge, and releasing the Contest Parties from all liability for any damage or loss arising from use of the prize. 

 

8. Legal

 

For Canadian residents:

 

8.1 These Official Rules are governed by the laws of the Canada and the laws of the Province of Prince Edward Island and the applicable federal laws and shall be construed according to the laws, excluding any rules of private international law or conflict of laws that would determine the application of any other legislation.

 

For U.S. residents:

 

8.2 By entering the Contest, entrants agree that any question or matter concerning the construction, validity, interpretation and enforcement of these Official Rules, the rights and obligations of the entrant, or the rights and obligations of the Sponsor related to this contest shall be governed by and construed in accordance with the laws of Canada and the Province of Prince Edward Island without effect to the principles of choice of law or conflict of laws. By entering the Contest, entrants consent to the jurisdiction and competence of the Province of Prince Edward Island, Canada.
